1. Acceptance of Terms

Welcome to SimpTab / 简 Tab ("SimpTab", "we", "us", or "our"). The Service is provided by Kenshin Wang, an individual / sole trader operating under the laws of the People's Republic of China.

These Terms of Service ("Terms") govern your access to and use of our digital products, including the minimalistic browser New Tab extension, Pro features, account and device authorization, and related websites and support, available at https://simptab.art/ (the "Service").

By creating an account, purchasing a Pro License, activating authorization, or otherwise using the Service, you confirm that you: (a) are at least 18 years of age; (b) have read, understood, and agree to be bound by these Terms; (c) agree to our Privacy Policy; and (d) are authorized to enter into this agreement on behalf of yourself or any organization you represent.

Important: If you do not agree to these Terms, you may not use the Service. Continued use after any update constitutes acceptance of the revised Terms.

2. Description of the Service

2.1 What we provide

SimpTab provides a minimalistic New Tab experience, including wallpapers, bookmarks / frequently used sites, clock and weather widgets, and optional Pro capabilities (such as multi-device authorization and account-related features, as actually enabled in the product). The Service is primarily a browser extension and accompanying digital services distributed over the Internet.

2.2 Nature of the Service

The Service is a digital intangible product. Access is granted upon payment confirmation and issuance of a License (or equivalent credential). Because of the immediate delivery of digital services, refunds are subject to the limitations in Section 7.

2.3 Free and paid

3. Account Registration

3.1 Account creation

Using certain parts of the Service (including Pro activation and device management) may require creating or linking an account with accurate information. You are responsible for keeping credentials, UID, License, and similar secrets confidential, and for all activity under your account.

3.2 Account security

• Notify us immediately of unauthorized use at [email protected].
• Do not share login credentials, License, or UID with any third party to circumvent device limits.
• Keep your billing and contact email address up to date.

3.3 Business accounts

If you register or purchase on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

4. Pro License & Plans

We offer a one-time Pro License that unlocks premium features within the concurrent device limits published for the product. For current plan details, device limits, and pricing, visit https://simptab.art/price.html.

We may modify features or introduce new plans at any time. A License already purchased remains valid subject to applicable law and these Terms. Price changes do not affect one-time purchases completed before the change, unless required by law.

5. Billing & Payment

5.1 One-time purchase authorization

Each Pro License (or equivalent paid offering) purchase is a one-time transaction. By completing checkout, you authorize us to charge your payment method for the amount shown at checkout. The product does not currently offer auto-renewing subscriptions. If we introduce subscriptions later, these Terms will be updated and recurring authorization will be obtained explicitly at checkout.

5.2 Payment processor

International card and related payments are processed by our Merchant of Record, Waffo Pancake. Other regions may use additional lawful payment channels we designate. Payment card data is handled by the processor and is not stored on our servers.

5.3 Taxes

Unless otherwise stated, prices may be tax-inclusive or tax-exclusive as shown at checkout (including VAT, GST, sales tax, or similar). Where required by law, the processor or we will collect and remit applicable taxes.

5.4 Delivery

After successful payment, we deliver a License (or equivalent) via the success page, email, or other instructions. You must activate it in the product as directed. Issues caused by an incorrect email, loss of credentials, or failure to follow activation steps do not automatically entitle you to a refund, though we may help re-issue upon verifiable purchase.

6. Cancellation, Accounts & Devices

6.1 How to stop using the Service

Because this is a one-time License purchase, there is no auto-renewal to cancel. You may at any time:

• Stop using the Service and uninstall the extension;
• Unbind devices via in-product account / device management;
• Email [email protected] to request deletion of account-related data where technically feasible and legally permitted.

6.2 Device limits

A Pro License may be used within the device limit stated in product documentation or on the pricing page. Exceeding the limit may block new device authorization or lock the account until you unbind devices. Circumventing device limits is a breach of these Terms.

6.3 Data retention

After you request deletion or an account is terminated, account-related data is handled per the Privacy Policy within a reasonable period; the default reference retention period is 90 days unless law requires otherwise.

7. Refund Policy

7.1 General policy

Due to the immediate and intangible nature of digital services, Pro License fees are generally non-refundable, except as expressly stated below.

7.2 Eligible refunds

• New purchase 7-day guarantee: First-time purchasers may request a full refund within 7 days of the initial charge if the License has not been activated, or if activated but Pro features have not been substantially used (as reasonably determined from logs and activation records).
• Duplicate charge: Full refund for billing errors resulting in a duplicate charge.
• Verified service outage (≥72 hours): Extended inability to use core Pro authorization due to causes within our control may qualify for a refund or remedy by agreement.
• Statutory rights: Rights of withdrawal or refund under applicable law (e.g., EU/UK 14-day withdrawal) are preserved; where permitted, withdrawal rights may be lost once digital content is downloaded or activated.

7.3 How to request a refund

Email [email protected] with your account email or UID, transaction / order ID, and reason. We will acknowledge within 2 business days and process eligible refunds within 5–10 business days (arrival time depends on the payment channel and banks).

7.4 Non-refundable items

• Fees outside Section 7.2 or after substantial use of Pro features (except where required by law).
• Accounts terminated for violation of these Terms or the Acceptable Use Policy.
• Issues caused solely by the user's environment (browser, OS, network) rather than a defect in our Service (we will still try to help troubleshoot).

8. Billing Disputes

If you believe a charge is in error, contact [email protected] before filing a dispute with your bank or card network. We will reply within 2 business days and resolve confirmed billing errors within 5 business days.

9. Intellectual Property

9.1 Our rights

Intellectual property in SimpTab software, trademarks, UI, documentation, and related materials belongs to Kenshin Wang or the respective rights holders. A License grants a limited, non-exclusive, non-transferable right to use the Service and does not transfer ownership.

9.2 Your content

Content you configure or upload (such as custom wallpapers or bookmark data, as supported) remains yours. You grant us a limited license solely as needed to provide the Service to you.

9.3 Open source and third parties

The Service may include open-source components or third-party materials under their own licenses. Wallpapers and similar assets may come from third parties; please respect their terms.

10. Acceptable Use Policy

10.1 Permitted use

You may use the Service only for lawful purposes consistent with these Terms, including personal productivity and legitimate work or study.

10.2 Prohibited use

You agree not to use the Service to:

• Engage in illegal, defamatory, harassing, or fraudulent activity.
• Infringe any third party's intellectual property or privacy rights.
• Bypass, interfere with, or disrupt security, authorization, device limits, or billing.
• Resell, rent, or share Licenses, or provide unauthorized access to others at scale.
• Reverse engineer, scrape, or attack the Service (except where mandatory law allows).
• Violate applicable laws, regulations, or card-network rules.

11. Data, Privacy & Security

Your use of the Service is subject to our Privacy Policy at https://simptab.art/privacy.html. Payment card data is handled by our processors (including Waffo Pancake) and is not stored on our servers.

12. Disclaimers & Limitation of Liability

12.1 Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR UNINTERRUPTED OPERATION.

12.2 Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential, or punitive damages. Our total liability is limited to the amounts you paid us for the relevant Service in the 12 months before the claim.

13. Term & Termination

These Terms remain in effect while you use the Service. We may suspend or terminate your account or License for material breach, suspected fraud, or legal requirements. If we permanently discontinue the Service for reasons other than your breach, we will handle refunds or remedies as required by law and reasonable commercial judgment. You may request account deletion by contacting [email protected].

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the People's Republic of China (excluding conflict-of-law rules). Before formal proceedings, please attempt informal resolution by emailing [email protected].

15. General

We may update these Terms at any time. Material changes will be announced on the website or by email at least 14 days before they take effect (where we have a valid email). Continued use constitutes acceptance. If any provision is held invalid, the remainder stays in force. These Terms and the Privacy Policy are the entire agreement between you and Kenshin Wang (SimpTab).
